Agents – real estate

There are three types of real estate agents

  • Listing or seller's agent. This is the agent whose name appears on the "For Sale" sign. He or she represents the interests of the seller solely. You do not have to use the listing agent to view or purchase the property. Information you share with the listing agent is not confidential.
  • Seller's sub-agent. Any agent other than one specifically engaged by you as a buyer's agent, who shows you a property is a sub-agent of the seller. A sub-agent represents the seller's interests and has no duty of confidentiality to you as a buyer.
  • Buyer's agent. A buyer's agent has a duty to represent only your interests, as well as keep confidential any information you may have shared. A Buyer's Agency agreement specifies the obligations of both the agent and the buyer working under the agreement.
